Definitions

"RentalsatSunset.com," "Rentals at Sunset," "we," or "us" refers to Rentals at Sunset, LLC, a short-term rental company located at 227 Clubhouse Rd 803, Sunset Beach, NC 28468, owned by James Clark Allison.
"You" or "your" refers to the user of RentalsatSunset.com or a guest booking a Property from Rentals at Sunset, LLC.
"Property" refers to the short-term rental property that you are booking from Rentals at Sunset, LLC.
"Agreement" refers to these terms and conditions.

Acceptance of Agreement

By using RentalsatSunset.com or booking a Property, you agree to the terms and conditions of this Agreement. If you do not agree to the terms and conditions of this Agreement, you may not use RentalsatSunset.com or book any Property.

Dispute Resolution and Arbitration
Any disputes arising out of or related to this Agreement, your use of RentalsatSunset.com, or your booking of a Property shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Brunswick County, North Carolina, and the decision of the arbitrator shall be final and binding on both parties. By agreeing to arbitration, you waive your right to bring a lawsuit in court.

Payment

You must pay for your stay in full at the time of booking. We accept payment through Braintree, PayPal, cash, and Zelle.

Cancellation Policy
Cancellation made prior to 60 days of the scheduled check-in date will be eligible for a full refund. Refunds may be available for cancellations made within 60 days of the scheduled check-in date if the unit rebooks at a discounted reimbursement based on price, but this is 100% at the discretion of Rentals at Sunset, LLC.

Check-in and Check-out
The standard check-in time is 4:00 PM, and the check-out time is 10:00 AM.

 

Property Conditions

The Property must be left in the same condition as it was found at check-in. If the Property is not left in the same condition, you may be charged for any damages.

Liability and Indemnification

Rentals at Sunset, LLC and James Clark Allison are not liable for any loss or damage to your property or belongings while you are staying at a Property. You are responsible for taking all necessary precautions to protect your property and belongings. Guests agree to indemnify and hold Rentals at Sunset, LLC and James Clark Allison harmless from any claims, damages, liabilities, costs, and expenses arising from their use of the Property, violation of any terms in this Agreement, or any third-party claims related to their stay.

Guest Conduct and Termination

Guests are expected to conduct themselves in a respectful and responsible manner during their stay. Rentals at Sunset, LLC reserves the right to terminate the stay without refund if guests engage in any disruptive or inappropriate behavior that disturbs the peace or violates any local laws or regulations.

Force Majeure

Rentals at Sunset, LLC and James Clark Allison shall not be held liable for any delays, cancellations, or changes to bookings resulting from force majeure events, including but not limited to acts of God, natural disasters, war, strikes, governmental actions, or any other events beyond their reasonable control.

Governing Law and Limitation of Liability

This Agreement will be governed by and construed in accordance with the laws of the State of North Carolina. To the maximum extent permitted by law, Rentals at Sunset, LLC and James Clark Allison shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses resulting from the use or inability to use the Property or RentalsatSunset.com.

Entire Agreement, Severability, Waiver, and Modifications

This Agreement constitutes the entire agreement between you and Rentals at Sunset, LLC regarding the use of RentalsatSunset.com and supersedes all prior or contemporaneous communications, representations, or agreements, whether oral or written. If any provision of this Agreement is held to be invalid or unenforceable, such provision will be struck from this Agreement, and the remaining provisions will remain in full force and effect. No waiver of any provision of this Agreement will be effective unless in writing and signed by both parties. Rentals at Sunset, LLC reserves the right to modify or amend this Agreement at any time. Any changes to the Agreement will be posted on RentalsatSunset.com.
